CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA WITHIN THE SCOPE OF THE LAW ON THE PROTECTION OF PERSONAL DATA NO. 6698

This Clarification Text has been prepared to fulfill the illumination obligation of Onka Global Danışmanlık Ve İthalat İhracat LTD. ŞTİ. (“COMPANY”) within the scope of the Law on the Protection of Personal Data No. 6698 (“Law”). In this context, our responsibilities and the information we are obliged to provide regarding the protection of your personal information are detailed below.

What is Personal Data?

In the Law on the Protection of Personal Data No. 6698, personal data is defined as "any information relating to an identified or identifiable natural person." Personal data includes not only information that directly identifies individuals, such as their name, surname, date of birth, and place of birth, but also information about their physical, family, economic, social, and other characteristics. The Law considers data concerning individuals' race, ethnic origin, political opinions, philosophical beliefs, religion, sect or other beliefs, clothing and appearance, membership in associations, foundations, or unions, health, sexual life, criminal convictions, and security measures, as well as biometric and genetic data, as special categories of personal data.

Data Controller

According to the Law, the data controller refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system. The responsibility for all personal and special categories of personal data of individuals who benefit from all services offered on the www.oiaformore.com (WEBSITE) internet site belonging to the COMPANY lies with Onka Global Danışmanlık Ve İthalat İhracat LTD. ŞTİ., located at Fulya Mh. Ortaklar Cd. Mevlüt Pehlivan Sk. Huzur Apt. Blok No:1 İç Kapı: 5 Şişli / İSTANBUL, registered with the Istanbul Trade Registry Directorate under number 363335-5.

Collection of Personal Data

Your personal data is collected automatically through forms you fill out when registering on our WEBSITE and/or making purchases, and through cookies, which are technical communication files, when you visit our WEBSITE. For detailed information about cookies, please review the Cookie Policy .

Processing and Transfer of Personal Data

Subject to collection with explicit consent, the following personal data may be processed by the COMPANY, its business partners, successors, and service providers:

  • Identity Information: name, surname, gender and age information, TR ID Number (processed only in accordance with legislation for the purchase of certain product groups)
  • Contact Information: GSM number, delivery address, e-mail address
  • Customer Transaction Information: order and invoice information, delivery transaction information, transaction information regarding past purchases, request and complaint information
  • Transaction Security Information: IP address information, password and passcode information, cookie information
  • Legal Transaction Information: information in correspondence with authorized persons, institutions and organizations, information in lawsuits and enforcement files, legal information request information

This data is processed directly or indirectly for the purposes of providing the best possible service to the COMPANY's customers, ensuring reliable and uninterrupted provision of products or services, maximizing customer satisfaction, processing payments, carrying out various transactions related to the aforementioned services, marketing and promotional activities, and fulfilling the requirements of contracts concluded with customers, in accordance with the procedures and principles in Article 4 of the Law and within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6.

In line with the purposes stated above and considering data processing reasons, personal data may be transferred to domestic and/or international service providers processing personal data on behalf of the COMPANY (logistics companies, call center companies providing customer service, database and infrastructure provider companies, SMS and e-mail sending service companies) within the framework of the personal data transfer conditions and purposes specified in Articles 8 and 9 of the Law No. 6698.

Rights of Data Subjects

Data subjects, in accordance with the regulation on “rights of the data subject” within the scope of Article 11 of the Law, have the right to:
a) Learn whether personal data is being processed,
b) Request information if personal data has been processed,
c) Learn the purpose of personal data processing and whether it is used in accordance with its purpose,
ç) Know the third parties to whom personal data is transferred domestically or abroad,
d) Request correction of personal data if it is incomplete or incorrectly processed,
e) Request the erasure or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law No. 6698,
f) Request notification of the operations carried out under clauses (d) and (e) to third parties to whom personal data has been transferred,
g) Object to the occurrence of a result against the person by analyzing the processed data exclusively through automated systems,
ğ) Demand compensation for damages in case personal data is processed unlawfully.

Pursuant to Article 13, paragraph 1 of the Law, requests regarding the exercise of the above-mentioned rights must be submitted to info@onkaglobal.com with a secure electronic signature or as a written, wet-signed document. The Company will finalize the request submitted in this manner free of charge within thirty days at the latest, depending on its nature. However, if the transaction requires an additional cost, the fee specified in the tariff determined by the Personal Data Protection Board will be charged by the COMPANY.
